After a five-day trial in Hudson County, Mintz & Geftic’s Bryan H. Mintz obtained a jury verdict against New Jersey PATH for work-related injuries suffered by his client. The NJ PATH worker tripped and fell while carrying a bridgeplate, which is used to bridge the gap between the train platform and the train. 

Mintz & Geftic’s client suffered serious injuries from his work accident. The injuries included herniated discs in his back requiring a four-level decompression surgery and he later endured another surgery for a post-surgical infection. The client also underwent months of physical therapy.

Since New Jersey’s workers’ compensation laws do not apply to employees of common carriers like NJ PATH, the case was filed under a federal statute known as the Federal Employers Liability Act, or FELA.  FELA is a federal law that protects and compensates railroad workers injured on the job if the worker can prove that the injury was caused in whole or in part by the negligence of the railroad.

During the trial, through expert testimony and lay witnesses, Mr. Mintz argued that NJ PATH neglected to provide proper training, did not provide a safe workplace, and that they failed to conduct proper inspections. The jury found that NJ PATH was 70% responsible for the fall and the related injuries that were sustained.   

Shortly after the liability verdict and before the trial on damages was set to begin, NJ PATH paid a significant lien for the injured worker's medical bills and an additional $420,000 for pain and suffering, resulting in a total settlement of $754,000.    

Through his hard work and drive, Mintz & Geftic’s client is now back at work.

Blizzard of 2017?

Who else here thought Spring had already started? I was wearing shorts at the park a couple of weeks ago thinking that we had made it through another winter. Well, maybe we all spoke too soon.

At last check, forecasts are pointing towards a major storm hitting New Jersey early next week. Will this be the Blizzard of 2017? 

Remember the Blizzard of '93?

For those thinking it's too late in the year for a blizzard, history indicates otherwise. The Blizzard of 1993 has been labeled the Storm of the Century and dumped 32 inches of snow on Elizabeth, New Jersey. When did that storm occur? March 11th and 12th of 1993. Are we in for the Storm of this Century? Or will we clear out the grocery stores this weekend only to windup with an inch or two? 

Top Winter Driving Myths

It’s a good time to separate facts from fiction when it comes to winter driving. If the Blizzard of 2017 does hit next week, please stay safe and let our great road crews do their work.

While taking it slow and putting down the cellphone will obviously help drivers avoid motor-vehicle accidents regardless of the road conditions, there are many myths out there when it comes to icy/snowy conditions. 

Myth #1: Most serious icy road crashes are caused by careless drivers.

Studies indicate that most serious weather-related car car accidents result from drivers who were NOT operating their vehicles in a careless manner. In most cases, they are driving normally at reasonable speeds when they suddenly encounter ice and crash.

 

Myth #2: I'm a good driver, and I have the skill and experience to drive highway speeds in ice and snow conditions.

On the contrary, a common factor in many of the most serious and fatal auto crashes is overconfidence in one's abilities and/or equipment.

 

Myth #3: Winter tires, 4WD, AWD, stability control, ABS and/or traction control allow for safe travel on icy roads at highway speeds.

"The reality is that there is no technology, no tire nor any vehicle type that allows SAFE travel on any type of icy road (snow, sleet or freezing rain) at speeds greater than 45mph. Not traction control, electronic stability control, 4WD, AWD, antilock brakes or the most expensive brand-new snow tires."

 

Myth #4: Everyone should buy winter tires - that would prevent most icy road accidents.

Myth #5: The worst icy road dangers are during big winter storms.


"The road ice hazard isn't the minor fender-benders or slide-offs common during snowstorms. The real danger is the serious, highway-speed crashes during light icing events that take drivers by surprise.  Most accidents in snowstorms happen at the onset of the storm or on its fringes, where accumulations are lower."

 

Myth #6: Salt, sand and plow truck crews are there to make roads safe for high-speed travel during snow and ice conditions, 100% of the time.

New Jersey's road crews work extremely hard plowing and salting the roads to keep them passable.  However, they can only treat so many roads at a time and sometimes keeping up during a storm just isn't possible.  Regardless, even roads that are treated aren't usually in ideal condition or safe for traveling at highway speeds.

 

Myth #7: Icy roads are a bigger threat in colder climates where ice and snow is common.
"The fatality and death rates per mile and per hour of winter precipitation events are actually higher in regions that only see a handful of snow and ice events each year."

A New Jersey bill has been signed into law that will regulate ride sharing companies such as Uber and Lyft in the Garden State. This new law, known as the Transportation Network Company (TNC) Safety and Regulatory Act, includes some important info that effects both drivers and passengers.

Here's the top things you should know:

Insurance Coverage for Uber Passengers Injured in Accidents

In the past, auto insurance companies have told ride-share passengers injured in accidents that their personal policies would not cover them. Under this new law, every passenger will now be covered. As New Jersey accident lawyers, this part of the law is something that will be a big help for our clients and all New Jersey ride-share passengers.

Under the new law, passengers suffering from accident injuries when riding in an Uber or Lyft vehicle will now have medical coverage. This policy will provide up to $1.5 million in coverage for passengers that are injured.

Anyone that has ever been injured in an accident knows how quickly medical bills can pile up. Whether it's a severe back or neck injury, traumatic brain injury, bone fractures or any other accident-related injury, the cost for treatment can be substantial.

As New Jersey accident lawyers, our clients have had to undergo MRI's, physical therapy and several other treatments to help them recover. These bills add up quickly and it is good to know passengers of Uber and Lyft will now have the necessary coverage to help them get the proper care for their injuries.

New Jersey Uber & Lyft Drivers - Mandatory Background Checks

Another key aspect of this new law is that all New Jersey Uber, and other ride-share, drivers must now undergo a driving and criminal background check. "Drivers would be banned from employment by a ride sharing company if they had been convicted of homicide, sexual assault, driving under the influence of drugs or alcohol, reckless driving and possession or sale of a controlled dangerous substance." Are These Background Checks Enough?

While these mandatory background checks are a step towards safer ride-sharing experiences, critics don't feel it is enough. These critics think that the new law should have required drivers background checks to include fingerprinting rather than just name checks. Fingerprinting would provide more thorough records and put Uber drivers on a level playing field with New Jersey's chauffeurs.

Uber has argued that riders submitting feedback on their drivers is basically a form of ongoing safety checks, but that sounds like some corporate spin from where I'm sitting.

While fingerprint checking is something that should happen sooner rather than later, this new law is still a step in the right direction. The insurance coverage for passengers will allow people with major injuries to get the care they need and deserve.

New Jersey Traffic Deaths Increasing

New Jersey traffic accidents lead to over 600 people tragically dying in 2016, according to a report released this week by the New Jersey state police. 

The number of fatalities occurring on the highways of New Jersey had been declining for several years, reaching a 20-year low back in 2013. However, since that time, the numbers are unfortunately trending back up and traffic experts have been pointing to a few primary reasons:

Fatal Crashes and Fatalities

  • The total number of fatal crashes in 2016: 576 (54 more deadly accidents than 2015)
  • The total number of fatalities from these crashes in 2016: 607 (45 more fatalities than 2015)

  • 333 were drivers of motor vehicles
  • 90 were passengers
  • 18 were pedalcyclists
  • 166 were pedestrians- Studies have shown that pedestrian accident rates increase as distracted driving frequency increases

Thanksgiving: Best and Worst Times to Travel

The cold air has settled in, the last of the leaves are falling from New Jersey’s trees, the Giants are playing well and the Jets are thinking about next season….it must be the week of Thanksgiving!

Getting the chance to spend quality time with loved ones while enjoying some turkey and pumpkin pie always makes this holiday a joyous time. However, as New Jersey's premier car accident law firm, we at Mintz & Geftic also know that holiday weekends bring about some of the most hazardous conditions on our roadways. This Thanksgiving will certainly be no exception according to most travel and auto accident experts.

AAA Travel is projecting that nearly 1.25 million New Jersey residents are planning a Thanksgiving trip of at least 50 miles. With 48.7 million people expected to travel across the country this week, AAA Travel is expecting the highest Thanksgiving travel volume on our highways since 2007.

While this number includes people choosing to fly to visit family for the holiday, driving is still the primary choice for most New Jersey drivers. In fact, more than 89 percent of all travelers are expected to travel by car, meaning 1.1 million New Jersey drivers will be taking to the New Jersey Turnpike, the Garden State Parkway and our other roadways in the coming days.

Best and Worst Times to Drive on Thanksgiving Weekend

The following is a breakdown of expected traffic for each day of the upcoming Thanksgiving weekend. This data incorporates reports from both Google Maps and Waze.

Tuesday: Peak traffic and accident reports from 4-8 p.m. Huge increase in usage starting from 1 p.m. until the end of the day.

Wednesday: If you need to leave on Wednesday, hit the road around 6am to avoid traffic delays. Peak traffic is from 3-7 pm, but large increase in drivers startis from 11am and continues until the end of the day. An increase of 63% in accident alerts is reported by Waze Users on this day. This includes rear-end collisions, serious injury accidents, truck accidents and other crashes due to the increased traffic.

Thursday: Driver behavior and car accident reports similar to a weekend day and not a work day.

Friday: Driver behavior and car accident reports similar to a weekend day and not a work day.

Saturday: Per Google's data, this is the worst day to return home after Thanksgiving. Their traffic data indicates that Saturday at 4pm is the busiest time, where traffic jams and accidents are increased.

Sunday: Worst day to travel after Thanksgiving according to Waze. They report that traffic jams increase by 240 percent and both car accident and truck accident reports are increased.

Monday: If people can take Monday off, traffic volume and accident reports are much lighter..

Bottom-line, avoid traveling Wednesday, Saturday and Sunday if at all possible. Otherwise, please travel safely and always remember to Put Down the Cellphone.

For this reason, we are happy to share the news that a bill has been proposed by New Jersey lawmakers that, if passed, would protect the rights of breastfeeding mothers in the workplace.

New Jersey Bill for Breastfeeding Moms in the Workplace

The proposed bill (New Jersey Bill A2294) seeks to amend an anti-discrimination statute dating back to 1945 to include breastfeeding among a number of categories, such as race, religion, disability, sexual orientation and more— that must be treated equally. It would protect nursing mothers from discrimination in getting a job, while at work, in securing housing, joining a club, accessing a loan or mortgage, or doing other business.

The new legislation would require New Jersey employers to provide a proper location (other than a bathroom stall) and a “reasonable break” for breastfeeding mothers to pump during work hours. The New Jersey bill would also make it a civil rights violation to fire a woman because she is breastfeeding during work hours.

 

Breastfeeding can lower breast cancer risk, especially if a woman breastfeeds for longer than 1 year. (breastcancer.org)

 

The medical evidence is overwhelming when it comes to proving the benefits of breastfeeding for both the mom and baby and finally the laws are starting to recognize this.
